WinchiLoan Terms and Conditions

1. Introduction

These Terms and Conditions (hereinafter referred to as the "Terms") constitute a legally binding agreement between you (hereinafter referred to as the "User") and WINCHI MICROFINANCE LIMITED (hereinafter referred to as "we," "us," or the "Company") regarding your use of the personal loan and related services (hereinafter referred to as the "Services") provided through WinchiLoan, an application developed by us. The Company is a financial institution duly registered and legally operating in accordance with the laws of the United Republic of Tanzania, holding a valid financial business license. Before using this application and its related services, please carefully read all the contents of these Terms. Once you start using this application, it indicates that you have fully understood and agreed to be bound by these Terms.

2. Definitions

2.1 Personal Information

Personal Information refers to information related to an identified or identifiable natural person (the "Data Subject"), including but not limited to name, identification number, contact details, financial data, etc.

2.2 Processing

Processing refers to any operation performed on Personal Information, including but not limited to collection, recording, storage, use, disclosure, transmission, deletion, or destruction.

2.3 Data Controller

The Data Controller refers to the entity that determines the purposes and means of processing Personal Information, which is WINCHI MICROFINANCE LIMITED, the operator of this application.

3. Scope of Application

3.1 These Terms apply to all personal loan services and related financial services provided through this application.

3.2 These Terms apply to all users of this application (hereinafter referred to as "Users").

4. Service Content

4.1 Loan Application and Evaluation

4.1.1 This application provides Users with a convenient channel for personal loan applications. Users can apply for loans by filling in online application information for authentication and submitting relevant materials such as personal basic information, financial status, and loan purpose.

4.1.2 We will conduct a comprehensive evaluation of the User's loan application in accordance with the regulations of Tanzanian financial regulatory authorities and our internal risk assessment system. Evaluation factors include but are not limited to the User's credit record, income stability, and debt situation.

4.2 Loan Disbursement and Management

4.2.1 Upon successful evaluation, we will disburse the loan funds to the bank account designated by the User, which is opened at a legally operating financial institution in Tanzania, based on the User's application amount and our approval results.

4.2.2 Users can query relevant information such as loan balance, repayment plan, and repayment records through this application and perform repayment operations.

4.3 Customer Service and Support

We will provide Users with customer service and support to answer questions encountered during the use of this application and the Services. Users can contact us through the customer service email help@winchiloan.com within this application or other means.

5. User Registration and Eligibility

5.1 Registration Requirements

5.1.1 The User must be a Tanzanian citizen who is at least 18 years old and has full civil capacity.

5.1.2 The User needs to have a legally valid mobile phone number and email address in Tanzania for account registration and receiving relevant notifications.

5.1.3 The User shall provide true, accurate, and complete personal information in accordance with the registration process of this application, including but not limited to name, identification number (or the number of other identity proof documents recognized by the Tanzanian government), contact address, work information, and income situation.

5.2 Eligibility Review

We will review the registration information submitted by the User to confirm whether the User is eligible to use this application and apply for loans. During the review process, we may request the User to provide further supporting materials. If the information provided by the User is untrue, inaccurate, or incomplete, we have the right to reject the User's registration application or loan application.

5.3 Account Security

5.3.1 The User shall properly safeguard their account information and shall not disclose it to any third party. If the User discovers any unauthorized use of the account or other security vulnerabilities, they shall immediately notify us.

5.3.2 The User shall be responsible for all activities conducted through their account. If losses are caused by the User's improper safeguarding of account information resulting in information leakage, the User shall bear the losses themselves.

6. Loan Terms

6.1 Loan Services

This platform provides personal loan application services, and Users can apply for loans based on their financial situation. This application will evaluate the User's loan eligibility based on factors such as the information provided by the User, credit status, and repayment ability.

6.2 Service Fees

In addition to interest, we may charge certain handling fees, management fees, and other fees based on the service content. The specific fee standards and collection methods will be detailed in the loan contract.

6.3 Repayment Method and Time

6.3.1 The User shall make full and timely repayments in accordance with the repayment method and time stipulated in the loan contract.

6.3.2 The User shall deposit sufficient repayment funds into the designated repayment account before each repayment date or perform repayment operations in accordance with the prompts of this application. If the User fails to make repayments on time, it will be regarded as overdue repayment.

6.4 Overdue Handling

6.4.1 If the User makes overdue repayments, we will charge overdue interest in accordance with the overdue interest rate stipulated in the loan contract. The overdue interest rate will be higher than the normal loan interest rate, and the specific overdue interest rate standard will be clearly stated in the loan contract.

6.4.2 Overdue repayments may also affect the User's credit record. We have the right to report the User's overdue information to Tanzanian credit information agencies. At the same time, we have the right to take legal collection measures, including but not limited to telephone collection, SMS collection, and entrusting a third-party collection agency for collection.

7. User Rights and Oblations

7.1 User Rights

7.1.1 The User has the right to apply for and use loans in accordance with the provisions of these Terms and the loan contract.

7.1.2 The User has the right to query loan-related information, including loan balance, repayment plan, and repayment records.

7.1.3 The User has the right to put forward opinions and suggestions on our Services and file complaints and reports against our violations.

7.2 User Oblations

7.2.1 The User shall provide true personal information and loan application materials and shall not provide false information or conceal important facts.

7.2.2 The User shall use the loan funds in accordance with the provisions of the loan contract and shall not use the loan funds for illegal purposes or activities that violate public order and good morals.

7.2.3 The User shall make full and timely repayments and comply with all the provisions of these Terms and the loan contract.

7.2.4 The User shall cooperate with us in loan review and post-loan management and provide relevant supporting materials and information as required by us.

8. Company Rights and Oblations

8.1 Company Rights

8.1.1 We have the right to review the User's loan application and decide whether to approve the loan application and determine loan conditions such as loan amount, term, and interest rate based on the review results.

8.1.2 We have the right to charge loan interest and related fees in accordance with the provisions of the loan contract.

8.1.3 If the User violates the provisions of these Terms or the loan contract, we have the right to take corresponding measures, including but not limited to suspending or terminating the User's loan services, requiring the User to make early repayments, and holding the User liable for breach of contract.

8.1.4 We have the right to adjust and change the service content and loan policies of this application according to market conditions and risk management needs, but we shall notify the User in advance.

8.2 Company Oblations

8.2.1 We shall provide Users with legal, compliant, safe, and convenient loan services in accordance with the provisions of Tanzanian financial regulatory authorities and these Terms.

8.2.2 We shall keep confidential the personal information and loan materials provided by the User and shall not disclose them to any third party, except as otherwise required by laws and regulations or for the disclosure required by national security or public interests.

8.2.3 We shall promptly handle the User's loan applications and consultation complaints and provide high-quality and efficient customer services.

9. Privacy Policy

9.1 Information Collection

We may collect the User's personal information, including but not limited to the information provided by the User during the registration process, loan application materials, transaction records, and device information. The purpose of collecting this information is to provide and improve Services, conduct risk assessment and management, and comply with legal and regulatory requirements.

9.2 Information Use and Sharing

9.2.1 We will use the User's personal information in strict accordance with the data protection laws of the United Republic of Tanzania and the provisions of this Privacy Policy. We may use the User's personal information for the following purposes:

- Processing the User's loan application and providing loan services.

- Conducting risk assessment and management to prevent financial risks.

- Improving the functions and user experience of this application and conducting market research and data analysis.

- Complying with legal requirements and cooperating with government investigations and law enforcement activities.

9.2.2 We will not sell the User's personal information to any third party. However, under the following circumstances, we may share the User's information with third parties:

Partners necessary for providing Services, such as credit assessment agencies, payment service providers, and collection agencies, but we will require these partners to comply with strict data protection and confidentiality obligations.

In accordance with legal requirements or to protect our legitimate rights and interests, the User's rights, or public safety, we may disclose the User's information to relevant government departments, judicial authorities, or other authorized agencies.

9.3 Data Security

We have taken a series of reasonable technical and management measures to protect the security of the User's personal information and prevent information leakage, tampering, or loss. However, although we strive to ensure data security, due to the openness and complexity of the Internet, we cannot guarantee the absolute security of the User's personal information. If a security incident such as information leakage occurs, we will promptly notify the User and take necessary measures to reduce losses.

10. Disclaimer

10.1 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions due to force majeure (including but not limited to natural disasters, wars, government actions, network failures, etc.). After the occurrence of a force majeure event, we will take measures as soon as possible to restore the normal operation of the Services and promptly notify the User of the relevant situation.

10.2 User's Own Actions

The User shall bear the losses caused by their own actions, including but not limited to losses caused by the User's disclosure of account information, violation of the loan contract in using the loan funds, and failure to make repayments on time. We shall not be liable for any such losses.

11. Dispute Resolution

11.1 Negotiation

If any dispute arises between the User and us due to these Terms and Conditions or the loan contract, both parties shall first resolve it through friendly negotiation.

11.2 Arbitration or Litigation

If the negotiation fails to resolve the dispute, both parties agree to submit the dispute to a Tanzanian court for adjudication in accordance with relevant laws and regulations. The arbitration award shall be final and binding on both parties. If both parties do not agree to arbitration, either party has the right to submit the dispute to a competent Tanzanian court for litigation.

12. Other Terms

12.1 Term Modification

We have the right to modify these Terms and Conditions at any time, and the modified terms will be published within this application. The modified terms shall take effect from the date of publication, and the User's continued use of this application indicates their consent to be bound by the modified terms.

12.2 Entire Agreement

These Terms and Conditions constitute the entire agreement between us and the User regarding the use of this application and the Services, superseding any previous oral or written agreements and understandings between the two parties regarding these Services.

12.3 Severability

If any provision of these Terms and Conditions is deemed invalid or unenforceable, such provision shall be deemed severable and shall not affect the validity and enforceability of the other provisions.

12.4 Notification Method

Any notices or information sent by us to the User will be delivered through the email address or SMS provided by the User during registration or by posting announcements within this application. The User shall promptly check the relevant notices and information to avoid missing important content.
